The right of suffrage, which includes the right to vote for our representatives in government, is the centerpiece of our nation’s democracy. Any deprivation, curtailment or limitation of such fundamental right upon any citizen through an election system that fails in meeting the standards for the secrecy and sanctity of the ballot makes the exercise of such right a sham. Furthermore the lack of transparency in the registration and appreciation of the ballot, where the public is unable to effectively monitor, swiftly examine and verify the process for any fraud, irregularity and manipulative conduct, including unintentional errors in the receiving and accurate counting of votes makes any democracy untenable.

In carrying out its mandate under the Constitution the Congress enacted Republic Act 9369, authorizing the Commission on Election to use an automated election system, which among other things, required minimum functional capabilities including the: (1) accuracy in recording and reading of votes as well as in the tabulation, canvassing, electronic transmission and storage of results; (2) provision for voter verified paper audit trail; (3) system auditability, which provides supporting documentation for verifying the correctness of reported election results and (4) which provides a system of verification that the machine has registered the voter’s choice. The minimum systems capabilities of the AES were intended to secure and protect the sanctity and indestructibility of the ballot. It requires that the voter must be able to verify, without detailed knowledge of computers, whether or not his or her vote as cast is truthfully recorded. Blind and ignorant reliance upon the capability and functionality of an automated system is not enough. The ability to personally inspect and confirm the proper and accurate registratiration of the vote is imperative. Indeed, simply being informed by an electronic display that the voter’s ballot has been registered, without benefit of verification for truthfulness is grossly inadequate.

We have received alarming reports and complaints from a growing number of voters who attest that their choice of candidates in the May 2010 election have not been properly registered or counted by the PCOS machines. They claim under oath that in the precincts where they voted, the election results show a much lesser number of votes obtained by Bangon Pilipinas candidates than the actual number of votes cast in their favor. They also claim that the PCOS machines in their clustered precincts do not provide them with any receipt, record, documentation or any other visible means of verifying the registration of their choice of candidates, thereby clearly violating the requirements of the law and the Constitution. These complaints which could ultimately involve millions of voters are matters of great and urgent national importance because they impact on the right of suffrage of the citizenry and constitute a grave threat to Philippine democracy.

While the AES has been popularly applauded for the efficient speed at which it has determined the election results and virtually eliminated some forms of cheating arising from the undue delay in the counting of votes, efficiency or expediency in determining electoral results can never compromise or substitute for the sanctity of the ballot which must at all times be protected.

For this reason, Bangon Pilipinas is thoroughly verifying these reports and complaints and has also asked its team of lawyers to study the possible adequate remedies to uphold and safeguard the sacred rights of the electorate and to submit their recommendations as quickly as possible.

We would like to assure everyone that the actions or remedies that Bangon Pilipinas will take, if at all necessary, will be for the Filipino people and not for the purpose of questioning the victory, prevent or contest the proclamation of any candidate as the winner in this historic electoral contest. In fact it will not be about protecting or upholding the rights or claims of any candidate. Its singular purpose is to preserve and defend our democracy by ensuring the secrecy and sanctity of the ballot of the citizenry as guaranteed under our Constitution. In this regard, we invite all voters who may have similar reports or complaints to come forward for the protection of their sacred right. ###

Beware and Overcome [YELLOW] Media Manipulation

READERS beware! If you want to get the truth regarding the recent national elections, go beyond what you get from the mainstream media. Do your own research. Check the facts on the ground. Ask what your friends experienced. Connect the dots yourself. Come to your own conclusion. In this way, you will protect your mind from being manipulated by unseen powers that lurk behind the country’s media establishment.

Immediately after the May 10, 2010 elections, the Filipino public was brainwashed with stories about a stunningly successful election. “ ‘Birth pains’ of poll automation over”. “Fast count stuns nation”. “Stocks surge as markets cheer successful elections”. “ ‘Villar conceding proves Comelec credible’ “. “Take a bow, Filipino voters”. “US, EU praise RP for elections; peso, markets buoyed”. “Comelec proves critics wrong”. “Filipinos carry on love affair with PCOS machines”.

The “Good job” editorial of the Philippine Daily Inquirer (PDI) captures the euphoria over the rapid success of the elections. In its May 12, 2012 editorial, two days after the elections, PDI wrote the following:
“Contrary to the most dismal expectations, . . . the country’s first nationwide automated elections have turned out to be a success. . . . the May 10 vote marked a true rite of passage. Our electoral system has finally caught up with the 21st century. . . . . For now, and while taking into consideration the remaining uncertainties in the election, our civic duty is to commend the many people who helped turn the first computerized polls into a success.”

PDI then thanked the presidential candidates for conceding to apparent winner Benigno Aquino III. PDI had special words for Manny Villar. PDI called his “gracious” concession a “class act”.

Understandably, amidst this sudden euphoria, when I did not concede victory to Aquino due to evidence of massive fraud in the elections, the gatekeepers in media started framing my decision as “sour grapes” or “sour loser”. They also distorted the facts in my press release or media interviews. And, if I did come out in the media, they would often attach “losing” presidential candidate to my name, to implicitly emphasize that I was a “sour loser”. They did not want to bring out that I was questioning the outcome of the elections, not for myself, but because it was the product of a fraudulent process and thereby endangered our democracy. (See my press statement, “I am not conceding”) Oftentimes, they would simply censor my comments and give a one-sided account of subsequent events that followed.

However, no one can suppress the truth. No one can overcome the truth. And indeed the truth regarding massive fraud in the elections started to surface all over, despite media bias against incidents of fraud.

News surfaced about 60 PCOS machines stored illegally at the private house of one Smartmatic technician. Irregular transmission dates were found in one of these PCOS machines. Reports also came out about flash cards found in the garbage dump in Cagayan de Oro City, implying an attempt to remove evidence of fraud. Alert citizens and IT experts also discovered that all election returns (ERs) were transmitted without the required digital signatures, a clear violation of RA9369, the law that authorized the establishment of the automated election system. Canvassing of votes cannot take place because the ERs are not valid. Further research by various groups has also revealed that COMELEC has violated more than 50% of the provisions of RA9369. This meant that the recent national elections were fraudulent, thereby also making the election results illegal. Then recently, several whistle blowers surfaced claiming massive fraud in the recent 2010 elections.

With these developments, media headlines started to slowly change, albeit begrudgingly and reluctantly and even antagonistically. They started carrying stories of fraud. “Erap focuses on ‘hocus PCOS’, an ‘electronic Garci’ system”. “Watchdogs call for probe of ‘poll irregularities’”. “Three losing pres’l bets troop to SC”. And so on.

Until finally, on 18 May 2012, PDI writes an editorial: “Reviewing the polls”. PDI wrote:

“Now, some people are having second thoughts: the automated elections system may have its faults, after all. . . . . The most prominent of the critics is deposed President Joseph Estrada . . . Estrada is refusing to concede saying that he is gathering evidence showing discrepancies in the transmitted results and other alleged irregularities. Three other presidential candidates, Senator Maria Consuelo “Jamby” Madrigal, Nicanor Perlas, and JC de los Reyes, have not conceded either saying that, while they may not win the presidency, they want to know the whole truth about the results of the presidential elections. . . . .
“That the new automated election system is being subjected to a thorough examination and critique by various sectors of society is a healthy sign for our democracy. It shows that voters are not content with just voting and receiving fast results; they want to be assured that the entire process is fair, accurate and credible. Elections are the instrument by which the will of the people is expressed. If the electoral system can be subverted, then we will not know how the people really decided.”

The PDI editorial marked the passage of the country from misinformed and naïve euphoria of a “stunning” “successful” election, to the messy reality that massive fraud may have been perpetuated in the recent national elections.

No matter what happens to the fate of the whistleblowers who have recently surfaced and the increasing number of impossible results being uncovered, one thing is clear. Mainstream media is not neutral. They have their preferences and interests to protect. They wield massive cultural power to convince millions that their interests and preferences are the truth, are the reality.

Do not yield to their mind games, to their mind manipulation. Stand firm. Make your own independent decisions. The emergence of truth about the national elections will depend on our collective deprogramming from the frontal mental attacks of media. And this truth will determine the future of our country.

Bangon Pilipinas investigates reports of possibly millions of uncounted Party votes

BANGON Pilipinas Party said it will investigate complaints from members that votes of their candidates were not counted in the last elections.

The Party said that while the automated electoral system has been applauded for the speed at which it generated the result of the May 10 election, “efficiency or expediency in determining electoral results can never compromise or substitute for the sanctity of the ballot which must at all times be protected.”

“We have received alarming complaints from a growing number of voters who attest that their choice of candidates in the May 2010 election have not been properly registered or counted by the PCOS machines. They claim under oath that in the precincts where they voted, the election results show a much lesser number of votes obtained by Bangon Pilipinas candidates than the actual number of votes cast in their favor,” BPP vice presidential candidate Perfecto Yasay said.

The complaints, he said, “could ultimately involve millions of voters. It is a matter of great and urgent national importance not only because it impacts on the right of suffrage of the citizenry, but if confirmed to be true, constitutes a grave threat to Philippine democracy.”

Bangon Pilipinas standard bearer Bro. Eddie Villanueva said he received reports that in many precincts where his supporters voted, he garnered zero votes. He said the party would verify the reports. “We will seek justice for this. Our lawyers will look into this matter,” he said.

Yasay also stated that the party’s team of lawyers is studying possible remedies “to uphold and safeguard the sacred rights of the electorate and to submit their recommendations as quickly as possible.”

He stressed that any action to be taken by Bangon Pilipinas on the reports ”will be for the Filipino people and not for the purpose of questioning the victory, prevent or contest the proclamation of any candidate as the winner in this historic electoral contest.”

“In fact it will not be about protecting or upholding the rights or claims of any candidate. Its singular purpose is to preserve and defend our democracy by ensuring the secrecy and sanctity of the ballot as guaranteed under our Constitution,” Yasay added.

He also invited voters who may have the same experience when they cast their ballots and monitored the counting to come forward. -end-

Evidence of Electronic 'Hello Garci' Mounting

Since the 11th of May the media have been asking us why we have not yet conceded and why one of us retracted an earlier concession. The question is not whether we should concede to any particular candidate but whether to concede or not to the validity and integrity of an unproven and flawed automated election system.

In the recent euphoria surrounding the perceived success of these automated elections we may sound like voices crying out in the wilderness, but ours is a voice of caution and reason, a stand based on principle rather than on personal politics and agenda.

We have decided to put the Filipino peoples’ interests at the forefront.  We have put our political agenda aside.   There has been a constant and steady flow of reports from the field that have suggested that there were considerable  problems with the automated elections.

At this point, there are some questions that I believe need to be answered:

  • How did the Comelec manage to recall, replace, debug and reprogram the 76,000 CF cards in a few days
  • What happened to the supposedly recalled CF cards? Where are they?
  • How sure are we that the same CF cards were not pre-programmed to favor particular candidates?
  • Is the automated election system really fool-proof ?  With the disabling of the UV lamps how sure are we that unused ballots were not filled up and counted in favour of certain candidates?
With this in mind we cannot in principle and with a clear conscience concede to a system which is unproven, not transparent and which has been riddled with technical and security flaws.
This is a national dilemma. This is why the COMELEC needs to prove to the Filipino people the transparency, accuracy and credibility of the system before we can make the correct moral and ethical choice.

We are making this stand so that the Filipino people will not be rushed into thinking that the automated election system is a success when millions have been disenfranchised and millions of votes may have been incorrectly counted.

This stand is not about winning or losing but about doing the right thing for the Filipino people at the risk of going against current popular public opinion.

We must make sure that the current elections were clean, fair and accurate. We cannot allow the recent automated elections to become an ‘’invisible electronic Garci.’’  That would undermine our democracy.

Election Update 1


//8:45 P.M.
UPDATE FROM Baguio   I left cluster 77 and78 at 8:30 P.M. because the technician can't transmit data. It's either of poor signalor he doesn't knowthe procedureas he was trying earlier to transmit wothout antennas./ grace c.

//6:49 P.M.
UPDATE FROM Baguio  Total of 480 out of 671 voted in cluster 77 and 451 out of 645 in cluster 78./ grace c.
//6:30 P.M.
COMELEC, in a press conference this afternoon, declared failure of  elections in several towns, including Guimbal, Iloilo, a town in  Samar, three towns in Lanao del Sur, and Basilan province.
Lack of training surfaces as a major problem in the current elections. PCOS machines failing because field technicians do not know how to insert the memory cards of the machines.
In Culiat, Quezon City, voters had to do manual voting because the PCOS machines were not available. The PCOS machine arrived around 2pm. 
But, in less than two hours, they are back to manual voting. In addition, around 200 voters could not find their names in the precinct list of voters.
Names of people who are dead are in the voter’s list. Goons create chaos in a precinct in Abra. Some people went home without voting due to the tension.
A BEI chairperson telling people whom to vote in Abra. A lot of precincts still have a lot of people who have not voted.
Power failure, memory card, PCOS failure, long lines, can’t find names – most common complaints. PCOS machines continue to fail.
In many precincts, more than 50% of voters have not cast their ballot.
GMA7 Election Map shows voting problems far outweigh successful voting. If this continues, then we are headed for a failure of  national elections.

Election process at Rafael Palma, Pasay City was orderly and transparent. No anomalous activities observed
//4:24 P.M.
Brgy Culiat Q.C. Representatives of local and national candidates are giving fyers inside the polling precincts. Manual voting conducted at 7 A.M. PCOS machines arrived at 2 P.M. Now the manual voting is starting again.

//3:39 P.M.

Everything is orderly in Mandaluyong. Out of 3,400 voters 4 ballots were rejected due to wrong shading. Voter turnout around 50% so far. It would have been much better if we got a receipt after putting our ballots in the machine to show us it really counted all the candidates we voted for. It's a shame the machine was not designed to do this.

One mayor  will give me 3K just for me to give up my Perlas vote for Gibo. I told him I am willing to be the only PERLAS in my barangay./Moses of Silliman

Cebu City What is your advice: one precinct of 8K voters with only 4 PCOS machines, processing only 10 voters per hour. Means only 120 voters by 7 P.M. Voter lists torn as poll volunteer left and voters grabbed at the lists themselves.
//12:20 P.M.
Political party personnel helping voters in Marawi City to shade their votes. This is an illegal practice.
Some ballots continue to be rejected by PCOS machine in Nueva Ecija.
In Guimbal, Iloilo, 300 voters could not vote because the wrong  ballots arrived. Comelec declared suspension of voting.
In Capiz, people are not breaking line to eat. They do not want to lose their turn. People are getting angry due to the slowness of the  process. BEI: “So far so good”. But people are disagreeing and  complaining that only 10 voters have voted in the past 4 hours.
In Maguindanao, in the town of Datu Unsay, explosions also occurred.  No voting for many hours.
Also in Maguindanao, BEI influencing voters whom to vote on the basis  of slips of paper.
Northern Maguindanao, goons of two candidates shoot each other,  killing at least one person.

Comelec website shuts down. Overwhelmed by voters looking for their precincts.
Only 15% of PCOS machines ready several hours after elections opened this morning according to www.gmanews. tv.
No compact flash cards in some precincts.
Four die of election related violence in Cotobato and Sibugay.
Comelec Command Center at PICC convenes National Board of Canvassers.
Comelec extends voting hours to 7pm. Comelec Chairman Melo did not expect the slow pace of the voting and high turnout of voters.
Comelec Spokesman Jimenez:  Assessment. As expected some machines will not function. 300 PCOS machines malfunctioning. 250 PCOS replaced. Still within safe limits expected by Comelec. Re missing flash cards. Not to worry. Overall, elections are doing well and results will be respected by the people. By 4 to 5am tomorrow can declare winners in municipal connections. (Interview done by 24 Oras, GMA7).
//11:26 P.M.

1. Nick and Chris Perlas were at University of Asia and the Pacific before 7 A.M. I arrived shortly afterwards. Their clustered precinct was 137.
2. Media coverage at the polling place: GMA7 Nelson Canlas; ABC 5- Zai Feniza; Philippine Daily Inquirer reporter DJ Yap and photographer Abellana;
Sunstar Virgil Lopez, Businessworld Grace Gato.  Philippine Star's reporter Rainier Rondo and photographer confirmed coverage but I didn't see them after I lined up to vote at 7:20 A.M. The TV coverage was aired live. Phil Star reporter Rainier later on requested for a interview with Nick. GMA 7 invited Nick to guest on Election 2010 at around midnight with hosts Arnold Clavio and Connie Sison.

3. I lined up at clustered precinct 138 at 7:20 A.M. and finished voting successfully at 9:45 A.M. Between 7 A.M. and 8 A.M. there was a lot of confusion in the polling place,with people trying to find their clustered precinct with the help of PPCRV volunteers and Comelec authorized support staff and looking for the end of the line that will lead them to their designated precinct. Finally, after an hour, a system of sorts emerged and the line was moving.People were saying that it was taking a long time to initialize the PCOS machines.  Still there were people who insisted on jumping the line. In precinct 138 a mother and daughter whom I know since they are my neighbors were allowed by 4 people wearing yellow t- shirts with black philippine map to sit with them. I reported this to the PPCRV and Comelec support staff  since there were 4 witnesses but they didn't do anything about it. I went to the PPCRV table and reported the same thing but still nothing was done, By the time I got back to the precinct the two were already voting. When they came out I told them that 4 of us witnessed that they jumped the line. And the mother said, they asked their neighbors ( the ones wearing yellow) to reserve their place in the queue.The other witnesses commented that when confronted the people involved couldn't really deny it.  In precinct 136, a senior citizen doctor and his daughter also a doctor were complaining that several senior citizens were allowed to jump the line but they were not allowed to do so. They also complained that the gay assistant of the barangay captain's partner was allowed to jumped the line ahead of them. While we were still in the queue, there was an announcement from the PPCRV head Mr. Cordova that voters should check their ballots carefully because at precinct 139 a ballot was given to a voter that was already filled up.

4. After I voted I helped out at the PPCRV desk . I completely forgot that I was a PPCRV volunteer! Hahahaha! I took down a complaint as follows:

In Precinct 139 a ballot filled in with Villar was given to a voter who was a friend of a certain Bojie Cabreza. The voter showed it to the election chairman of the precinct who replaced it with a new ballot and the filled ballot was set aside. The report was filed by Julia Labao who is a watcher for the Liberal party.

I submitted the report to Mrs. Cordova for filing with the PPCRV. I also told Julia Labao to look for the Comelec support staff and file a similar report.

5. Problems at the PPCRV assistance desk included people not finding their names on the master list or on the supplementary list. A couple by the name of Barranechea said they checked with Comelec on May 9 and their names were in master list. I told them that the electionchairman of the precinct where they are supposed to go to had a master list with photos and thumb marks so if they want to take the chance and stand in line for 2  to 2 and half hours to check this. And they agreed to stand in line and take the risk because they really wanted to vote for God and country..Bravo citizens! Also assisted so many senior citizens, disabled people and voters with health conditions and gave instructions that only the precinct's election chairman can decide on a case to case basis if they will be allowed to jump the line. But not all of the precinct chairmen allowed senior citizens and those with health conditions to jump the line.
Two men said they knew their precincts but did not want us to check their clustered precinct and they didn't line up.Another PPCRV volunteer confirmed that this was very suspicious.

UPDATE from Bel-Air Makati: 2 hours to queue, I started at 7 and voted at 9. There was no UV lamp to verify my ballot's authenticity. It was easy to go to the PCOS machine, security was lax. Queues were long but manageable, people were following rules.

Unpublished comment to Huffington Post's insult on RP politics & "comfort" endorsement of Noynoy Aquino

THE Huffington Post recently published an article that was rather anomalous in its ignorance of current Philippine politics, as reflected in its partisan endorsement of Liberal Party candidate Benigno "Noynoy" Aquino, as well as in its condescending remark on the how movie stars and "nut jobs" get to hold elected positions. The particular paragraph that got my ire is this:
"Noynoy is the comfort candidate. In a country where crooks, charlatans, film stars, sportsmen and nut jobs routinely stand for, and get voted into office, Mr. Aquino represented a steady and secure vote."
 How ignorant and insulting can Virginia M. Moncrieff get? She's all praises for Aquino, ignoring his extremely poor legislative background of having absolutely no bills passed. What does he mean by "comfort candidate" in the first place? I hope it's nothing like the Filipina "comfort women" of World War II period.

In the title, Huffington Post even had the uninformed gall to call Noynoy Aquino "President elect." (Who is this guy? Philippines President Elect - Mr Vanilla of Manila). That is rather based on futuristic, if not speculative, thinking given that the Commission on Elections has yet to proclaim Aquino as the winner of the May 10, 2010 polls. Moreover, since the author was so much in a hurry to name Aquino "President Elect," she has missed consideration of the fact that three of the tail-end candidates who admit their electoral defeat refuse to concede on grounds of what apparent poll fraud.

 As a Filipina patriot who feels Moncrieff and her readers ought to be more informed, and who feels slighted by her sweeping, rather disdainful description of Philippine politics, I dutifully posted a comment. Unfortunately, while it got posted in my Facebook account, it was axed by the moderators. I feel that comment ought to see print so I'm posting it here:
Sounds like CIA-type endorsement to me. How haughty can you get looking down on Filipino film stars getting elected. Hey, your country has your share. Remember the Hawk RONALD REAGAN and now, that ARNOLD SWARZENEGGER?

Re Noynoy Aquino, who says he is "comfort candidate"? You? How would an incompetent congressman then senator with ZERO-ZERO bills passed and who was opportunistic enough to capitalize on the death of his mother be a comfort candidate?

Are you aware that his mother Cory Aquino approached the man they helped deposed backed in 2001, ex-Pres. Joseph Estrada, so Noynoy Aquino can be included in the opposition's senate slate in 2007?

And are you even aware of the psychological incompetence issue being thrown at Noynoy Aquino? An issue he skirted by REFUSING psychological testing even when practically all other presidential candidates expressed their agreement to undergo one? And are you aware that many who did not vote for Noynoy Aquino FEAR he is most unfit for the job because he is a bit of a psychologically challenged case?

Also, we may have corruption here in the Philippines but, at least, we DO NOT KILL our presidents, unlike some country I know? :)

The right of suffrage, which includes the right to vote for our representatives in government, is the centerpiece of our nation’s democracy. Any deprivation, curtailment or limitation of such fundamental right upon any citizen through an election system that fails in meeting the standards for the secrecy and sanctity of the ballot makes the exercise of such right a sham. Furthermore the lack of transparency in the registration and appreciation of the ballot, where the public is unable to effectively monitor, swiftly examine and verify the process for any fraud, irregularity and manipulative conduct, including unintentional errors in the receiving and accurate counting of votes makes any democracy untenable.

In carrying out its mandate under the Constitution the Congress enacted Republic Act 9369, authorizing the Commission on Election to use an automated election system, which among other things, required minimum functional capabilities including the: (1) accuracy in recording and reading of votes as well as in the tabulation, canvassing, electronic transmission and storage of results; (2) provision for voter verified paper audit trail; (3) system auditability, which provides supporting documentation for verifying the correctness of reported election results and (4) which provides a system of verification that the machine has registered the voter’s choice. The minimum systems capabilities of the AES were intended to secure and protect the sanctity and indestructibility of the ballot. It requires that the voter must be able to verify, without detailed knowledge of computers, whether or not his or her vote as cast is truthfully recorded. Blind and ignorant reliance upon the capability and functionality of an automated system is not enough. The ability to personally inspect and confirm the proper and accurate registratiration of the vote is imperative. Indeed, simply being informed by an electronic display that the voter’s ballot has been registered, without benefit of verification for truthfulness is grossly inadequate.

We have received alarming reports and complaints from a growing number of voters who attest that their choice of candidates in the May 2010 election have not been properly registered or counted by the PCOS machines. They claim under oath that in the precincts where they voted, the election results show a much lesser number of votes obtained by Bangon Pilipinas candidates than the actual number of votes cast in their favor. They also claim that the PCOS machines in their clustered precincts do not provide them with any receipt, record, documentation or any other visible means of verifying the registration of their choice of candidates, thereby clearly violating the requirements of the law and the Constitution. These complaints which could ultimately involve millions of voters are matters of great and urgent national importance because they impact on the right of suffrage of the citizenry and constitute a grave threat to Philippine democracy.

While the AES has been popularly applauded for the efficient speed at which it has determined the election results and virtually eliminated some forms of cheating arising from the undue delay in the counting of votes, efficiency or expediency in determining electoral results can never compromise or substitute for the sanctity of the ballot which must at all times be protected.

For this reason, Bangon Pilipinas is thoroughly verifying these reports and complaints and has also asked its team of lawyers to study the possible adequate remedies to uphold and safeguard the sacred rights of the electorate and to submit their recommendations as quickly as possible.

We would like to assure everyone that the actions or remedies that Bangon Pilipinas will take, if at all necessary, will be for the Filipino people and not for the purpose of questioning the victory, prevent or contest the proclamation of any candidate as the winner in this historic electoral contest. In fact it will not be about protecting or upholding the rights or claims of any candidate. Its singular purpose is to preserve and defend our democracy by ensuring the secrecy and sanctity of the ballot of the citizenry as guaranteed under our Constitution. In this regard, we invite all voters who may have similar reports or complaints to come forward for the protection of their sacred right. ###

Tell me this isn't CHEATING (Elections 2010)

So, I'm out of the country and really excited by election results. I decided to check results in my town (Monti baby!) just to see who was winning. Awesome site by Comelec by the way. Everything's in pie graphs. I digress. I'm randomly checking precincts when I saw one with an almost improbable results. Aquino with 734 votes, Acosta with 3 votes and Villar with 1 vote. I said to myself, "Wow! Super landslide si Noynoy!" then went on to check the results for the other positions. What got me worried was with the results of the partylist. I know most of the people couldn't care less about partylist and if you probably ask 10 different people in the room about which partylist they're voting for, you'll probably get at least 5 different answers. With this posted result, Alagad partylist got 700 votes and the next 4 got a vote each while the rest got zero. Whatthe? Senator, Board Member and Councilor votes got concentrated on the top 12, top 4 and top 8 respectively with the following candidates getting single digit votes.

This would have been a rare coincidence if it happens on one precinct. But once I checked the others, I came up with 3 more that shows similar results.

Now, please tell me that this is a rare coincidence. That I'm being paranoid and overcritical because these things could actually happen. Because right now, my mind is jumping to conclusions. That maybe, this automated elections (and I've been very very complimentary of it) is not as safe from cheating as we have been told it is.

Checking the locations of the precincts, it is located in Tagumpay Elem. School, Tagumpay Comp. San Jose, Rodriguez, Rizal.

Oops.. The photos were too small but you can still see the outline of having 3 digit votes and single digit votes for the next one. Please do check the website to see what I am saying.

I am in no way assuming that a particular candidate or party manipulated the results.

After reading all your comments, I think the most likely explanation is indeed INC block voting. I also considered this as a possible reason early on in the comments section (which won't show the earlier comments, I'm not sure why). I did not do this to seek attention or gain popularity or what not. I believe I was doing my job as a citizen in questioning any possible anomalies in results. I did bring up several possibilities early on in the comments section. Also, let me clarify, I believe in this system and do not wish to inflict blame on it. I commend Dick Gordon for proposing automated elections and the Arroyo government for pushing through with it.

I think I let enough time pass for discussion. Let us all be happy that a reasonable explanation has been brought to our attention and this matter can be closed.

Appeal by Nicanor Perlas: WERE OUR VOTES COUNTED?

Presidentiable Nicanor Perlas has issued a press statement yesterday to the effect that he refuses to concede because he believes that:
Aquino does not have a clear mandate. He is not yet the undisputed winner of the elections. Joseph Ejercito Estrada may eventually surpass Aquino. Even if this does not happen, Aquino’s potential mandate remains indeterminate due to the partial failure of the automated election system (AES). The AES may have prevented as many as 5-8 million Filipinos from voting. It is premature to say that the elections were fair and honest. Fast returns? Yes. Relatively peaceful? Yes. But accurate, clean and honest? Doubtful.

The following is the appeal letter released by his office in regards their attempt to determine the accuracy of the elections based on how accurate the counting of Perlas votes were.


Dear Volunteers and Supporters,

As part of our ongoing research in determining whether the electoral process is fair, clean, and accurate, we are going to cross check votes actually casted for Nicanor Perlas versus votes that were transmitted by the PCOS machine and tallied and counted by Comelec. We need your assistance in this task.

To those who are willing to contribute, may we know the following information:

1. Your precinct number and area (barangay/municipality/city/province);
2. If you voted for Nicanor Perlas;
3. The number of other people you are DEFINITE who voted for Nick in your precinct/clustered precinct (family, friends, neighbors).

Election Results Remain Indeterminate and Unfair due to the Partial Failure of the Automated Election System

Contrary to rumors in media, I am NOT conceding the elections to presidential candidate Benigno Aquino III. I will wait for Comelec to officially give its final tally and its explanation as to how it will address the reality that millions of Filipinos were not able to vote due to long lines, PCOS machine failures, and/or mismanagement in a significant number of polling places. Then I will make my final decision.


I am NOT conceding because, at this point, Aquino does not have a clear mandate. He is not yet the undisputed winner of the elections. Joseph Ejercito Estrada may eventually surpass Aquino. Even if this does not happen, Aquino’s potential mandate remains indeterminate due to the partial failure of the automated election system (AES). The AES may have prevented as many as 5-8 million Filipinos from voting. It is premature to say that the elections were fair and honest. Fast returns? Yes. Relatively peaceful? Yes. But accurate, clean and honest? Doubtful.

I am endorsing neither Aquino nor Estrada. I am making a point beyond the presidency of an Estrada or an Aquino. Neither is this is a statement about me or my candidacy.I am concerned about the accuracy and honesty of the country’s electoral process, the heart of the democratic exercise. If there is to be a President in this country, he or she has to have the true mandate of the Filipino people. I do not mind if Filipinos want to put a traditional politician in office as long as this reflects the true will of the majority of Filipinos.

Yes, I ran as presidential candidate. But even more important, I also ran to ensure that this country would have a credible national election so that we can all graduate from the curse of tainted elections and the specter of an illegitimate government. As long as the will of the people is not truly expressed, I cannot concede to whatever government will arise out of the recent national elections.

More importantly, I am not conceding because to do so would prevent me from asking questions on whether our electoral process accorded sanctity to each and every ballot. There are questions that remain unanswered. Yes, we are getting the results fast. But fast does not mean accurate. A number of crucial questions remain unanswered. I am making this statement to appeal to Filipinos that we need to look beyond superficial or quick-fix solutions. We should not be easily swayed by a quick broadcast of results. This masks deeper issues that are yet to be resolved. Let us move beyond band-aid solutions and look deeper, determine whether the electoral process was fair, clean, and accurate. Before we claim victory and celebrate based on quick results, let us ensure that the results reflect the true sovereign will, that voters were not disenfranchised, that the machines were not compromised, and that votes were not bought.

We should rebuild this country on the basis of a strong foundation. This entails that our citizens were able to exercise their right to vote, that their votes were counted, and that these votes were accorded sanctity. This is the very core of our democracy. This makes inviolable the sovereignty that guarantees that all government power emanates from the people. And this can only be done if we are able to truly prove that our elections were clean, honest and credible. Without this solid basis, we cannot rebuild the nation.

Here are my reasons for the above statements.

Comelec has reported that 50.7 million voters registered for the May 10, 2010 elections. Of this amount, Comelec declared that seventy five percent (75%), or approximately 38.03 million, cast their ballots. As of 6:00pm yesterday, Comelec counted 30.4 million votes, leaving 7.63 million votes still to be considered. Of the 30.4 million votes counted, Aquino has 40% or 12.16 million of the votes and Estrada has 25.4% or 7.72 million of the votes. Estrada is lagging behind Aquino by 4.48 million votes.

On the day of the election, Comelec expected 85% or 43.09 million voters to cast their votes. If this had been the case, then, 12.69 million votes would remain to be counted after yesterday’s count of 30.4 million votes.

However, it is entirely possible that the actual turnout in the May 10, 2010 elections reached 90% of all registered voters, or 45.63 million voters. During election day, Comelec stated that the voter turnout was higher than expected. Television footages and the direct experience of voters seemed to confirm that this was the case. If this were true, then, after subtracting the 30.4 million votes already counted, Comelec would still have account for 15.23 million remaining votes, assuming 90% turnout.

We thus have the following summary:

At 75% voting turnout, 7.63 million votes remain to be counted.
At 85% voting turnout, 12.69 million votes remain to be counted.
At 90% voting turnout, 15.23 million votes remain to be counted.

From the above summary, it is clear that Aquino’s lead of 4.48 million votes over Estrada can be undermined by the remaining votes to be counted. Furthermore, the election returns (ER) are not statistically representative of the entire population of voters. It is thus entirely possible that the next wave of votes to be counted will show a shift in favor of Estrada and other presidential candidates.

Equally as important, as many as 5-8 million people may not have been allowed to vote due to the long lines and substandard time and motion study of Comelec. We arrive at this figure by taking the difference between the 85-90% voting turnout and 75% voting turnout preferred by Comelec.

Clearly, the outcome of the election is not yet clear at this point and may not be cleared up in the future because of some failures in the automated system. And this does not yet take into account the lack of transparency in the automatic counting of votes and the inner workings of the PCOS machine system, especially its source code and flash card programming.

In addition, the random manual audit, that still has to be completed, may show further glitches in the process. And, even this part of the AES may not resolve the potential problems presented above, because the sample size is too small to be representative of the reality it is trying to measure.

All these do not yet include the problems of large scale vote buying, not to mention the blatant violation of election rules, the documented campaign inside precincts, and other illegal practices.

While we can express appreciation for the comparatively peaceful elections, the race is not over. And Comelec has a lot of explaining to do regarding the large amounts of disenfranchised voters. Only then can we move on to the urgent task of rebuilding the country.#

SWS and Pulse Asia in violation of R.A. 9006?

ARE the Social Weather Stations (SWS) and Pulse Asia in violation of the Fair Election Act (Republic Act No. 9006)? While it is true that  SWS managed to make section 5.4 of the act declared unconstitutional, which means they can publish surveys even up to election day, they're still not complying with important provisions of the law--those stipulated under sections 5.2 and 5.3.

       Sec. 5.2 of Rep. Act 9006 stipulates that the following information be provided with every published election surveys:
            (a) The name of the person, candidate, party or organization who commissioned or paid for the survey;
            (b) The name of the person, polling firm or survey organization who conducted the survey;
            (c) The period during which the survey was conducted, the methodology used, including the number of individual respondents and the areas from which they were selected, and the specific questions asked;
            (d) The margin of error of the survey;
            (e) For each question for which the margin of error is greater than that reported under paragraph (d), the margin of error for that question; and
            (f) A mailing address and telephone number, indicating it as an address or telephone number at which the sponsor can be contacted to obtain a written report regarding the survey in accordance with Subsection 5.3.
 Former Sen. Kit Tatad recently charged that polling firms have been in violation of the Fair Election law for refusing to abide by the full disclosure provisions of said law. SWS and Pulse Asia, he said, have been committing election offenses for failure to publish all material needed material data to enable public determination of the reliability of survey results. Despite repeated formal requests, the former senator says that SWS refuses to provide all the legally required information on questionnaires, methodologies, sponsorships, etc. as Pulse Asia insists on keeping its sponsors 'confidential.'

An important as the provision in section 5.2 is the one stipulated in section 5.3, which requires no less than RAW DATA from the survey firms. The relevant part of the one-paragraph section goes as"

"The survey together with raw data gathered to support its conclusions shall be available for inspection, copying and verification by the COMELEC or by a registered political party or a bona fide candidate, or by any COMELEC-accredited citizen’s arm."

Electoral survey firms are not supplying raw data either. What is more disturbing is how the Commission on Elections seems to be ignoring the violations. This has prompted Sen. Tatad to formally ask COMELEC  en banc to enforce the Fair Election Act on SWS and Pulse Asia, along with other polling firms.

It does not take much gray matter to figure out why the law asks polling firms to provide the public with raw data and other information such as the methodologies and questionnaires used, along with sponsorships. Unverifiable, unreliable surveys fed into the public consciousness constitute a dangerous tool of poll trending. Instead of merely measuring voting preferences and  other forms of opinions and perceptions, false survey results can serve as a tool of electoral bandwagon/trending conditioning to favor certain candidates.

Surveys play an important role in modern-day democracies. However their misuse becomes a dangerous tool of controlling public opinion that is counter to the essence of the concept of fair play and empowerment of the people. The Fair Election Act clearly requires SWS and Pulse Asia to make their survey information public but they chose to be secretive about certain data. It does not take a lawyer to see the survey poll bodies' electoral offense. So why is COMELEC not implementing the law?

Perhaps, a better question is why the survey firms continue to refuse to disclose the required information. In the current presidential race, the pre-electoral surveys of both SWS and Pulse Asia almost decisively and consistently show Liberal Party's Noynoy Aquino as front-runner. By opting to be secretive in apparent violation of the R.A.9006, are these two mainstream survey outfits actually trending for the yellow candidate? Nagtatanong lamang po.

Gloria-Gibo Cheating on May 10, 2010?

Despite my partisan optimism that former President Joseph "Erap" Estrada will regain the seat that he undemocratically lost during the 2001 EDSA 2 power grab by way of a new mandate in an orderly elections come May 10, 2010, what I actually expect is CHEATING. In that Gloria-evil-perpetuated cheating scenario, GIBO will emerge the "victor."

The 'VILLAROYO' talk of a 'secret' administration candidate strikes me as a charade. Just look at Gibo's obstinate "loyalty" to the Illegitimate President. This, amidst incessant reports of  presidential contender Manny Villar's (or Noynoy Aquino's?) supposed secret deal with Gloria Macapagal Arroyo, in which scenario Arrobo will be allowed to sit as House Speaker and then possibly alter the constitution to allow her to become Prime Minister.

Gilbert "Gibo" (daw) Teodoro rationalizes his astoundingly unwavering loyalty to his president by professing to don the Filipino value of "utang na loob" (sense/feeling of gratitude or indebtedness). How in heaven's name did the administration party's standard bearer come to regard the "Most Corrupt President in Philippine History" as worthy of his gratitude?

Then Vice-President Gloria showed nary a sense of utang na loob towards then incumbent President Joseph Estrada when she and her husband took part in the 2001 power grab. After all, Estrada trusted her so much so that he made her a cabinet member, appointing her Secretary of the Department of Social Welfare and Development. No less than the First Gentle__g Mike Arroyo divulged their crucial role in the ouster of Erap when he detailed "Plan A" and "Plan B" to acclaimed writer Nick Joaquin during the March 2001 Philippine Graphic magazine interview. If the object of the LAKAS official presidential candidate's professed utang na loob does not know gratitude, why would a seemingly intelligent man like Gibo insist on professing loyalty to Arroyo supposedly based  on that Filipino value?

Gibo being tied to a selfish, megalomaniac creature like Gloria by utang na loob makes no sense. Unless the rope of loyalty is more of  a dark scheme glued by the collusion of corruption with a vision of the post-May-2010 perpetuation of such a demonic arrangement. Take note of the danger signs abounding--Comelec mock polls showing 50% disenfranchisement; voters' list not being purged properly enough (the Board of Election Inspectors, instead of the computer, made in charge of the operation); Supreme court-upheld Comelec decision to push through with full automation despite non-pilot testing in what should have been two areas each in two provinces, municipalities, and cities; virtual elimination of security measures; PCOS failure; human intervention in the balloting, with the BEI doing checking for authenticity with hand-held UV lamps; and even printing errors that have misaligned the ovals, rendering them unreadable.

More disturbing is the Illegitimate government's apparent inclination to call the elections fraudulent. National Security Council chief Norberto Gonzales recently claimed that cheating for the 2010 polls has begun. Conveniently not naming names, Gonzales said candidates have supposedly started bribing officials of the COMELEC, Armed Forces of the Philippines and the Philippine National Police.

How ridiculous is it to hear the administration camp responsible for the 'Hello Garci'  2004 presidential electoral fraud operations warning about looming cheating in the coming polls? Further, this unsupported 'warning' comes amidst mainstream survey results showing their standard-bearer Gibo as tailender candidate. Doesn't this sound like a Plan B in case automated cheating fail.  Doesn't it sound like a propaganda ploy to condition the people's minds into peacefully accepting a failure of elections scenario in the bid to somehow stall Arroyo's step-down from power? Perhaps, create a mayhem situation to allow the outgoing Illegitimate to consolidate power and take power anew on her own terms?

The dangers signs of cheating for Gloria's continued de facto reign are too great to ignore. Gibo's unfaltering loyalty to his illegitimate, most unwanted "President" is equally disturbing. It is not difficult to see that Gloria would not be willing to face charges for her string of gargantuan crimes committed against the nation during her horrific nine-year reign. As insurance against her likely incarceration when she steps down, the Illegitimate simply  WONT allow a non-ally to take her place. Nobody should lose sight of that.

The Filipino people should not let them be taken in for another Gloria ride. Never underestimate the evil's mind! Despite his low survey ratings, Gilbert Teodoro, with Gloria's more-than-willing conspiratorial help, might just pull off the second biggest electoral (fraud) surprise in the nation's history. Next, of course, to the 2004 cheating conducted against Fernando Poe Jr., the genuine 14th President of the Philippines.

An automated Hello Garci this May? If the Filipinos failed to protect their votes in 2004 when elections were manual, how much more now with compromised "automation." All eyes on Gibo now.

Denmark's "guilt" over annual killing of hundreds of the famous and intelligent Calderon dolphins

 Denmark is the perpetrator of a horrendous crime.

The sea is stained red and it's not because of the climate effects of nature. 


 It's because of the cruelty of human beings ('civilised' humans) who kill hundreds of the famous and intelligent Calderon dolphins.


This occurs yearly in Feroe Iland, Denmark. The main participants in this slaughter are young teens.
 
The rationale?  A celebration,  to show that they are adults and mature!

  
 In this big celebration, nothing is missing from the 'fun'. Everyone is participating in one way or the other, killing or looking at the cruelty as a supporting spectator.




The dolphins don't die instantly; they are cut 1, 2 or 3 times with thick hooks and  produce a grim cry like that of a new born child.


  They suffer cruelly; and there's no compassion while this magnificent creature slowly dies in its own blood.


Its time to stop! We won't only read. That would make us accomplices, viewers. 

Bring this to the attention of the world, of relevant organizations.



This is even worse than Japanese whale-killing for meat! Imagine frenzied dolphin killing as CELEBRATORY RIGHT of PASSAGE?



CRY OUT AGAINST THE SLAUGHTER IN SUPPORT OF THE CALDERON DOLPHINS!
